- Each client may have their own preferences that may differ from the general best practices listed herein.
- Partners may have individual preferences. Discuss with supervising partner.
II. GETTING STARTED
- Review court, judge requirements including Local Rules and Standing Orders, judicial profile, experience with insurance coverage matters (paralegals can gather this information).
- Review information about opposing counsel including web site bio, other cases, articles and speaking on insurance topics.
III. LOCAL COUNSEL
- Establish a good professional and personal relationship from the beginning.
- Do not use local counsel only as a “mail drop.” Confirm scope of their local counsel’s responsibilities in writing (e.g., email or letter).
- Local counsel should understand the legal arguments and case strategy and should offer their insights - it is a team effort.
- Local counsel should advise on local rules, customs, and quirky procedures.
- Local counsel, however, should be advised not to perform independent research or write reports without authority from us.
- Local counsel should communicate through us, not directly to the client.
- A good relationship with local counsel can result in referral work for us.
