I. INTRODUCTION
Iron-Starr Excess Agency Ltd. on behalf of its subscribing insurers Ironshore Insurance Limited, Starr Insurance & Reinsurance Limited and/or Hamilton Re Ltd. (“ISEA”) views its relationship with its outside legal counsel as a long term strategic partnership with a shared commitment to excellence. These Litigation or Arbitration Management Guidelines (the Guidelines) have been implemented to enable ISEA to achieve greater efficiencies and cost savings while ensuring high quality legal services on selected claims. The Guidelines must be strictly adhered by outside law firms and other related vendors and any proposed deviation from these procedures must be agreed to in writing by ISEA. ISEA may withhold payment for any portion of an invoice that is not in compliance with these guidelines.
These Guidelines set forth our expectations, help define our working relationship and ensure that we work together effectively. Successful outcomes in all litigated and pre- litigated cases require the close interaction and constant communication between legal counsel, the claim professional, and on occasion, the insured. ISEA believes in the timely development and critical evaluation of a claim or suit. Only by the combined efforts of legal counsel, the claim professional and, where applicable, the insured in coordinating activities, joint decision-making and delivery of wide-ranging documentation will ISEA achieve the desired result in a claim or suit.
ISEA continues to examine ways to increase the efficiency of, and manage the costs of legal fees and expenses for, legal services provided by outside law firms and other related vendors. ISEA requires that the practices and procedures set forth in the Guidelines be followed in all billing activities and ISEA reserves the right to add, delete, or modify the practices and procedures set forth in the Guidelines at any time. Modifications to the practices and procedures set forth in the Guidelines shall become effective upon receipt of written notification by the outside law firms and other related vendors. Unless exceptions are approved in writing, these Guidelines constitute the terms under which you are engaged when employed by ISEA.
